Trees are not just a part of the character of the subdivision, they are also a regulated by the City of Port Orange.
Property owners wishing to remove a tree must comply with HOA and City procedures prior to removing any tree.
Country Walk HOA
No trees of at least six (6) inches in diameter at one foot above the natural grade can be cut or removed without approval of the ARB.
A tree which has been confirmed to be diseased, dead, or creates an immediate danger to property and/or people nearby may be removed prior to receiving ARB approval, as long as the ARB is made aware of the situation. In any case, a Request for Modification form must still be submitted by the homeowner for HOA records.
Any tree that is removed or has fallen, whether due to an act of nature or by the homeowner, must have its associated stump removed or grinded to a depth below the surface of the surrounding soil.
City of Port Orange
Per City code properties are required to maintain one (1) shade tree per 2500 sq ft of lot space. A permit is required to remove a tree from the property.
If the removal of a tree results in a noncompliance, the owner will be required to replace the tree with a tree from the Approved Species List (see here). In some cases, you may be allowed to substitute two (2) understory trees for one (1) shade tree.
A permit is not required to remove invasive or dead trees. However, you will need to provide a detailed report from a certified arborist for approval prior to the tree removal. If the report is acceptable there will be no fee for the permit.
Homeowners will need to supply the following:
A survey, site plan, or sketch of the property showing the type, size (diameter), and location of all trees on the lot and clearly mark the tree(s) you wish to remove with a “x” (Tree Removal Permit Instructions).
HOA approval (Request for Modification Form)
Arborist letter if the tree is dead/poses a hazard, or is invasive.
